Entering a BrandMap contest or survey never costs you anything - there is no entry fee, deposit, or stake of any kind. Prize money is funded entirely by the hosting business as a marketing expense, not by other players' entry fees.
Most contests are question-and-answer challenges (multiple-choice, written-answer, and photo-answer questions) where winners are determined by correctly answering the most questions - a game of skill and knowledge, not chance. Some contests may instead use a random draw among everyone who completed the contest, or a business-defined prize split; the selection method for a specific contest is always shown before you play.
Indian law generally treats "gambling" as requiring a player to stake something of value in a game of chance - since BrandMap never charges players to enter, we believe our contests (including random-draw ones) fall outside that definition and operate more like a promotional prize giveaway. That said, gaming law in India varies by state and is evolving, including rules specific to "online real-money games." This is not legal advice, and we can't guarantee how a specific state or court would classify a specific contest. If you have doubts about the legality of a contest where you live, don't enter it.
You keep ownership of the answers, photos, and other content you submit to a contest or survey. By submitting it, you grant BrandMap and the business hosting that specific listing a non-exclusive, royalty-free licence to use, reproduce, and display it for the purposes of running that listing - scoring and verifying your entry, investigating fraud or disputes, and, only where that listing's own terms say a winning entry may be showcased, displaying it publicly.
Don't submit photos that include another identifiable person unless you have their permission - the licence above extends to anyone whose image appears in content you submit, and you're responsible for having that permission.
If you believe content on BrandMap - a listing, a brand page, or another user's submission - infringes your copyright or other rights, tell our Grievance Officer (see our Grievance Redressal page) with enough detail to identify the content and your rights in it. As an intermediary under the Information Technology Act, 2000 and the rules made under it, we act on valid takedown notices and on court or government orders; we don't independently adjudicate every rights dispute, so a disagreement between two people about ownership may need to be resolved between them or through a competent authority.
We use device fingerprinting, submission-pattern checks, and withdrawal-pattern checks to detect the above. In most cases these hold an action for human review rather than instantly banning an account, since shared devices and networks are common and false positives are possible.
We may suspend or terminate an account, and refuse service to anyone, for violating these terms, for suspected fraud, or where we reasonably believe it's necessary to protect other users, businesses, or BrandMap - including while an investigation is ongoing, and in serious cases without prior notice. Funds already legitimately won are not forfeited as a result of a suspension under review, unless the winnings themselves are found to be the product of prohibited conduct, in which case we may withhold or reverse the related payout as described in Section 4.
BrandMap connects businesses and players; we are not a party to the specific contest, survey, or offer content a business creates, and the hosting business - not BrandMap - is responsible for the prize, reward, or coupon it promises, the accuracy of its content, and honoring a valid coupon at redemption. We do our best to verify businesses and moderate content, but we can't guarantee every listing is error-free or that every business will honor its obligations, though we'll assist with disputes as described in our Refund & Cancellation Policy and investigate reports that a business isn't honoring its obligations.
The service is provided "as is" and "as available." To the maximum extent permitted by law, BrandMap disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We aren't liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, or loss of goodwill, arising from your use of the platform, even if we've been advised of the possibility. Our total aggregate liability to you for any and all claims arising out of or relating to your use of BrandMap is limited to the greater of (a) any wallet balance genuinely owed to you at the time the claim arises, and (b) any fees you personally paid to BrandMap in the 12 months before the claim - which, for players, is typically zero, since players never pay to enter.
You agree to indemnify, defend, and hold harmless BrandMap and its officers, employees, and affiliates from any claim, loss, liability, or expense (including reasonable legal fees) arising from: your breach of these terms; content you submit or upload; your violation of any law or a third party's rights; or, if you're a business, the contest, survey, offer, or prize/coupon you host or promise. This doesn't apply to the extent a claim arises from our own breach of these terms or violation of law.
If you have a complaint about content on BrandMap, a contest, survey, or offer outcome, or how we've handled your account, contact our Grievance Officer - see our Grievance Redressal page for contact details and response timelines.
These terms are governed by the laws of India. Subject to the grievance process above, the courts of Kozhikode, Kerala have exclusive jurisdiction over any dispute that isn't otherwise resolved.
